Supreme Court Reinstates ‘Remain in Mexico’ Policy for Asylum Applicants

WASHINGTON—The Supreme Court on Tuesday reinstated a Trump-era plan that requires asylum applicants to wait around in Mexico while their statements are evaluated by U.S. authorities. The three liberal justices dissented.

President Biden canceled the Trump administration Migrant Safety Protocols, frequently termed the Keep on being in Mexico plan, responding to criticism that it compelled susceptible migrants to wait around out their situations in violent border towns. Reduce courts observed the administration unsuccessful to abide by good treatments in ending the plan and that the alternate of paroling into the U.S. asylum applicants en masse may well violate federal regulation.

The Biden administration requested the Supreme Court to let it cancel Keep on being in Mexico while it appealed, but in a brief order Tuesday night, the justices explained the authorities was unlikely to prevail.

The administration “failed to exhibit a chance of achievement on the claim that the memorandum rescinding the Migrant Safety Protocols was not arbitrary and capricious,” the unsigned order explained. Justices Stephen Breyer, Sonia Sotomayor and Elena Kagan indicated they would have granted the government’s application.

The Justice Department did not straight away answer to a ask for for remark.
